GENERAL TERMS AND CONDITIONS OF SALE
These conditions exclusively govern the mail order sales of alcohols and accessory products by CHÂTEAU PLAISANCE. In the absence of any specific provision in these conditions and agreed upon in writing between the parties, particularly in the commercial offers of CHÂTEAU PLAISANCE, orders are subject to these general terms and conditions of sale regardless of any clauses that may appear on documents completed by the buyer.
PURCHASE
CHÂTEAU PLAISANCE may refuse the benefits of its offers to any individual or legal entity proven to be or representing a professional reseller. CHÂTEAU PLAISANCE reserves the right to cancel or refuse any order from a customer with whom there is a dispute regarding a previous order. Offers are valid as long as stocks last and within the deadlines indicated. Default quantities proposed in the order cart are modifiable. However, to avoid breakage risks during transport, we recommend grouping these products in lots of 6 bottles or multiples thereof.
All orders are accepted subject to their simultaneous payment.
PRICE
Our prices are inclusive of all taxes in our commercial offers (except en primeur wines) and are valid in metropolitan France. They are applicable for the duration of validity mentioned on our commercial offers or quotations. Products are invoiced based on the tariff in effect at the time the order is registered.
PAYMENT CONDITIONS
When the client makes a payment on the site, CHÂTEAU PLAISANCE does not have access to the client’s bank information. For orders paid by credit card (Carte Bleue, Visa, Mastercard), the payment is authorized at the time of online payment and is automatically collected when the entire order is shipped.
If a payment is refused, the client must then contact their bank to ensure there are no malfunctions in their financial accounts. CHÂTEAU PLAISANCE cannot be held responsible for this type of situation.
In case of default or rejection of payment, the client is liable in addition to the principal amount, for late interest equal to one and a half times the legal interest rate.
Our products remain our property until full payment of their price.
DELIVERY AND RECEIPT
Products are delivered to the address provided by the buyer. In case of a change of address, the buyer is asked to notify CHÂTEAU PLAISANCE. In the event that the products cannot be delivered, the buyer becomes responsible for all return shipping costs. For any other delivery, a shipping cost estimate will be sent to you and must be validated before shipment.
Standard delivery service is carried out within 8 to 10 working days from the receipt of the order by our services. Shipments occur from Monday to Friday, except on public holidays and closing days at CHÂTEAU PLAISANCE. Orders placed on weekends or public holidays or closing days are validated on the next working day.
SUBSTITUTION
Wine is a “living” product that nature gives us in variable quantities depending on the years. Some wines achieve rapid success, leading to stock shortages. Faced with this situation and with the aim of satisfying our customers, we may offer you a substitute wine with the same quality/price ratio. Otherwise, we will refund you.
RIGHT TO RETURN - RIGHT OF WITHDRAWAL
You have the right to withdraw from this contract without giving any reason within fourteen days. The withdrawal period expires fourteen days after the day on which you, or a third party other than the carrier and designated by you, physically takes possession of the last good.
To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by an unambiguous statement by postal mail at:

To meet the withdrawal deadline, it is sufficient for you to send your communication regarding the exercise of the right of withdrawal before the withdrawal period has expired. You must return or hand over the goods to, CHÂTEAU PLAISANCE, PLAISANCE 33330 SAINT-SULPICE-DE-FALEYRENS – FRANCE, without undue delay and in any event not later than fourteen days after you communicate your decision to withdraw from this contract. This deadline is met if you send back the goods before the fourteen-day period has expired. You will have to bear the entire cost of returning the goods.
Effects of withdrawal
In case of withdrawal on your part from this contract, we will reimburse all payments received from you, including delivery costs (with the exception of additional costs arising because you have chosen, if applicable, a delivery method other than the less expensive standard delivery method offered by us) without undue delay and, in any event, no later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, this reimbursement will not cause you any fees. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
Exception to the right of withdrawal
The exercise of the right of withdrawal is excluded for the following contracts:
- contracts for the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for hygiene or health protection reasons
- contracts for the supply of goods which, after being delivered, and by their nature, are inseparably mixed with other items
PERSONAL INFORMATION
In accordance with Article 27 of the Law No. 78-17 of January 6, 1978 “Informatique et libertés”, the client has the right to access, modify, correct, and delete data concerning them. To exercise this right, the client must go to their personal account and modify their information. The client can also exercise this right:

PROTECTION OF MINORS
The ordinance n°59-107 of January 7, 1959, the law n°74-631 of July 5, 1974, and the article L.3353-3 of the Public Health Code prohibit the sale of alcohol to minors. Every client ordering wine from CHÂTEAU PLAISANCE thereby commits to being over 18 years old at the date of the order.

In accordance with the provisions of the French law n° 98-536 of July 1, 1998, transposing the directive 96/9/EC of March 11, 1996, on the legal protection of databases, CHÂTEAU PLAISANCE owns all or part of the databases comprising this site. All data appearing on this site (texts, images, graphics, logos, icons) are protected by copyright and cannot under any circumstances be used on other external media without express agreement from us.

LIABILITY AND APPLICABLE LAW
CHÂTEAU PLAISANCE reminds that the abuse of alcohol is dangerous for health and it is not responsible for the consequences of its consumption. These general terms and conditions of sale are subject to the application of French law. The contractual information is authored in the French language. In case of dispute, the client will first contact the customer service of CHÂTEAU PLAISANCE to find an amicable solution. In case of failure of these negotiations, the court of the registered office of CHÂTEAU PLAISANCE will have exclusive jurisdiction for any dispute arising from the application of these general terms and conditions of sale without exclusion of any recourse by CHÂTEAU PLAISANCE to another competent jurisdiction.
HEALTH NOTICE
Abuse of alcohol is dangerous for your health. Drink with moderation. Alcohol consumption during pregnancy is dangerous for the child.

Wines sold within the framework of Private Sales are subject to the T&C presented above taking into account the following specificities:
- Private Sales are confidential and have a defined duration.
- The wines offered for sale have limited stock.
